Formation of the conceptual device of risk-management is the important problem as practice shows, the term "risk" is treated and perceived differently not only heads of the organisations and experts, but also scientists. In the present work necessity of updating of the current legislation regulating questions of granting of insurance protection, for the purpose of a non-admission of excessive use of concept "risk" is proved. Author's offers on perfection of the insurance legislation which will allow to avoid an ambiguity and possible points at issue in relations between insurance organizations and insurers are made.
