Development of the legal and regulatory framework for central counterparty in Russia

The article is devoted to the legal and regulatory framework in Russia for central counterparty(CCP) - an important infrastructural institution in the financial market that plays centerpiece role in the risk management and in securing implementation of the participants’ liabilities incurred in respect of transactions. The author presents his thorough analyses of the draft law on «Clearing and clearing activity» adopted in the first reading as well as of an existing regulatory framework, concerning the areas of the CCP activity, from the point of view of their perfectibility, correspondence or collision. Based on deep analyses the author formulates the problems and proposals aimed at improving regulative efficiency and reducing systematic risks.
