Use of terms of road construction in criteria of appraisal of concession tenders

Transport is one of classical sectors is which are developed different forms of public-private partnership. Selection of public-private partnership is not the end in itself but means for realization of economic activity and public life. Benefits of private investors and operators is that in framework of public-private partnership the state assumes definite part of expenses, risks and also uses the existing administrative resource for increase of appeal of a corresponding project for a non-public participant. The research made showed that availability of a criterion “Term of road construction” in the list of concession tender criteria and a corresponding procedure of accrual of tender points under this criterion leads to significant losses for the state but appreciable financial benefit for private sector. The results received prejudice the fact of conduct of concession tenders and objectivity of received results. The author thinks that the state should make changes in the existing legislation about concessions and change the procedure of conclusion of a concession agreement and definition of its effective period.
