Importance The article considers the concept of power service contract, as a mechanism that helps solve the problem of creating conditions for attracting investment to upgrade basic hardware.
Objectives The paper aims to describe the consequences for the energy service industry caused by the requirements of normative legal acts, regulating the activities, and identify the causes of the situation where the requirements distort the original objective of setting up such a mechanism as the power service contract.
Methods For the study, we used a conceptual analysis and econometric methods.
Results As a result of the analysis of the basic energy service concepts, we find that at present, there is no adequate interpretation to understand the terms of energy conservation and energy efficiency, in the sphere of legal documentation, or the academic community.
Conclusions We conclude that, in order to improve the efficiency of the Russian economy today, first of all, it is necessary to create conditions to attract investment, which could ensure the modernization of basic production equipment.
