In the article a particular reason, hampering economic development of modern Russia - the poor quality of law-making is examined. The authors substantiate their positions critical analysis of a number of provisions of the Civil Code updated. It is concluded that the necessary legislative measures to enhance the role and significance in the social production of those who participate in it to their human capital, intellectual and physical abilities. The result will be reinforced by the motivation of workers.
