In the given article the special emphasis is given to the mechanism of the goal achievement that the German state set, when it introduced the institution of insolvency. There is a snapshot of the terms «insolvency» and «bankruptcy» in the German legal and economic systems and also a description of the evolution and modern legal system of the German institution of insolvency. The article deals with the description of the initiating and peculiarities of the legal insolvency proceedings in Germany.
