Special aspects of applying foreign experience in intellectual property protection when formulating a national innovation strategy

Importance Practically significant R&D results are of special value for producers aiming to take the lead in global and local commodity markets. Registration of inventions in national and international patent organizations is one of widely used methods of protection. In an extremely competitive environment, corporations often bypass the restrictions established by institutions of intellectual property protection and violate the rights of researchers and patent holders.
Objectives The aim is to develop recommendations for intellectual property protection when formulating the innovation strategy of Russia based on foreign experience.
Methods The study draws on method of economic analysis, observation, and a systems approach.
Results In the USA, there is an insurance mechanism protecting innovation enterprises from losses related to violation of intellectual property rights. Inventors use various methods enabling to minimize risk of losses from of patent infringement. However, these methods require disclosure of technical information, which can be used by competitors creating similar product or technology.
Conclusions and Relevance The choice of methods to protect R&D results and intellectual property depends on priorities of national innovation strategy. A strategy of advanced development implies that domestic products are expanding globally, thus requiring a reliable protection of intellectual property. A strategy of catching-up development focuses on creating high-technology samples of machines, equipment, materials based on the most recent scientific and technical achievements.
